Belleville, Illinois Nursing Home Sued, Accused of Breaking Resident’s Leg

Recently, a Belleville, Illinois nursing home was sued by a resident who claims the facility is responsible for breaking her leg.  Lillie Avant, a resident of The Lincoln Home, Inc., claims that facility staff members broke her leg while turning her on to her right side to reposition her.  After hearing loud popping noises, Avant cried out in pain and immediately grabbed her leg.

The lawsuit names The Lincoln Home, Inc. and Weiss Management Group, Inc. as defendants, and Avant seeks more than $50,000 from both.  The resident accused the Belleville facility of breaking her leg multiple times, then failing to do anything about it.    The suit was filed on October 12, 2010 in St. Clair County Circuit Court.

May 31, 2010 is when the incident occurred; at least three employees heard the popping sounds according to Avant, and witnessed her grabbing her leg.  She claims that no one notified either her doctor or her legal representative about the incident.  The lawsuit also claims that Avant’s son and daughter both visited the facility that day, and that five hours later when her daughter arrived Avant had still not received medical attention.

On June 1st, Avant was transported from Lincoln Home to Memorial Hospital, where she was treated for multiple knee and leg fractures.  That evening, it is alleged that a representative of the facility visited Avant while she was heavily medicated in order to get a signed statement regarding the incident.

Lincoln Home is a 152 bed for-profit facility with a one-star overall rating, which is well below average for ratings that are given by the U.S. Centers for Medicare and Medicaid Services.  One star is the lowest possible score given to a nursing home facility by CMS.
