Valley View Skilled Nursing Facility in California fired six employees following an incident concerning dementia patients. Apparently, the employees slathered a lubricant over several of these residents from head to toe so that they were hard to handle for workers on the next shift. These former employees were arrested and face several misdemeanor charges including battery committed on an elder or dependent adult, battery while on hospital property, conspiracy and injury to elder or dependent adults.

Four of the fired employees were directly involved in the abuse, which was inflicted on seven elderly patients, while two others who knew of the incidents failed to report the abuse to authorities. The California State Attorney General’s office identified those former employees who were charged as Kathleen Phillips, 23, Jared Buckley, 29, Jenny Bido, 26, Christina Guerrero, 30, Jennifer Burton, 33 and Monica Smith, 51.

This is one instance of a nursing home making the right decision by firing the employees for their abusive actions. While this kind of treatment may seem juvenile (and it is), it could put the lives of the patients in danger if those staff members on the next shift were to drop them or be unable to hold on to a patient while walking to the bathroom, which could result in broken bones, fractures or worse.

Many forms of abuse and neglect occur at nursing homes and elderly care facilities, some physical and some mental. When you place your elderly loved one in a skilled care facility, you expect them to get proper care and treatment – but this is not always the case. All too often our loved ones develop bed sores because they are not turned frequently, they are starved and not given medication on time, and even slapped or beaten by ruthless employees. It is often the very people you trust to care for your loved one who neglect and abuse them.

If you suspect that your loved one is not being given the proper care in a nursing home or have seen evidence that causes suspicion, contact a New York nursing home abuse lawyer immediately.

Jean Engstrom, a 51-year-old woman who was mentally ill, drowned on July 4th in a bathtub at the West Rogers Park facility where she was discovered with the water still running. The Cook County medical examiner’s office have yet to determine whether the drowning was accidental, or perhaps a suicide or homicide. Whether or not this was a case of nursing home abuse or neglect is still in question.

Nursing homes in Chicago and elsewhere are supposed to supervise residents with medical or mental conditions when needed as they bathe. When a resident has a severe mental deficiency they require monitoring, because some people with these conditions do become suicidal. While it seems nearly impossible, an individual can drown in only inches of water in a bucket, bathtub, pool or any other source of water, and it takes only 4 minutes without oxygen for permanent brain damage or even death to occur. Frequently, especially with someone who is mentally ill or elderly, victims are unable to call for assistance.

While it isn’t clear what happened in Engstrom’s case, it is nonetheless a tragic situation. If someone was supposed to be supervising due to her mental condition, the Warren Park Nursing Pavilion may be looking at severe penalties or fines.

Nursing home abuse and neglect does not only occur when a resident is slapped or hit. Various types of neglect can include failure to provide meals and medications on time or staff members not assisting when an elderly or disabled resident needs to bathe or visit the toilet. Some residents have fractures or other injuries that prevent them from getting out of bed on their own, and they need assistance as well. Abuse can be mental as well as physical, as some nursing home employees taunt residents and threaten them.

You expect your loved one to be provided for and taken care of when they enter a nursing home or elder care facility. If you suspect abuse or neglect, report it to authorities immediately. If you still get no satisfaction, contact a capable Buffalo nursing home abuse and neglect lawyer to learn about the rights of your loved one.

While we all know that nursing homes often fail to provide the care and protection our elderly loved ones are entitled to, nursing homes often fail to provide adequate security when it comes to visitors. Unfortunately, the lax practice of letting visitors come and go with hardly a notice by staff members has resulted in what is alleged as rape at Woods Nursing Home in Tennessee.

Just days ago, an 18 year old man entered the facility to visit a patient at the nursing home, and allegedly raped the elderly female patient. A Madisonville man has been accused of the crime against the woman, who is 79 years old. The nursing home is located in Sweetwater, Tennessee and police department spokesman Kenny Wilkins reported that Caleb Belcher, the 18 year old man in question, was arrested on charges of rape and elder abuse and held without bond.
Sweetwater police were assisted by the Tennessee Bureau of Investigation.

While most of us realize that nursing home abuse and neglect does occur in many of the facilities we trust the care of our loved ones to, we don’t usually think about such brutal acts as rape. Nursing homes should do a better job of policing who comes in to their facility, so that things like this do not happen. If nursing homes were to account for visitors, determine which resident they are there to visit, and have them sign in and out, horrendous acts like this would not occur.

Elderly people are vulnerable, and should never be subjected to this type of treatment. If nursing homes enforced stricter visitor policies, an incident such as this one would never be a worry to family members who have loved ones in nursing home facilities. There are enough issues in nursing homes and elderly care facilities without having to worry about your loved one being the victim of a brutal attack.

Nursing home residents have rights, and should be protected. If you suspect that your loved one is being abused or neglected in a nursing home or elderly care facility, alert authorities. A reputable Buffalo nursing home abuse lawyer can advise you on what steps you should take if you believe your loved one is being mistreated or improperly cared for in a nursing home.

According to an article appearing in the Tennessean.com concerning elder abuse, only 1 out of 23 cases usually gets reported to authorities.

How can this happen? The article states that the primary reason is that our elderly loved ones often have very limited access to the outside world, due to the control of those who are their caregivers – and who inflict the biggest part of the abuse on our family members. Since caregivers have this control over residents of nursing homes in some instances, the abuse never gets reported to authorities.

While some people think of abuse as striking or physically assaulting someone, there are many forms of abuse. In a nursing home, elder abuse can be anything from intentional isolation to neglecting to provide food and medications on time. Our elderly loved ones are also often frightened that they may be punished, so they do not report these incidents to either family members or authorities at the facility.

Sometimes, family members are too quick to ignore symptoms of abuse or neglect; they are oblivious to the fact that abuse does take place at a nursing home or elder care facility. While we should be able to trust in the fact that our loved ones are getting great care in these facilities and are well provided for, this is often not the case.

For those of you with loved ones in a nursing home, the following may indicate that your family member is being abused, although these symptoms certainly do not prove abuse:

Bed sores
Abrupt change in behavior
Disturbed or changed sleeping patterns
Dirty living conditions
Bed sores
Fractures/unknown bruising
Withdrawal
Substantial withdrawals from bank accounts

The sooner that authorities are contacted after suspected abuse or neglect, the more likely the perpetrator inflicting the abuse will be caught. Elderly people offer suffer from dementia and other conditions that affect the memory, so evidence that could prove to be valuable may soon fade away if not acted upon promptly.

If you suspect your loved one is being neglectedor abused in a nursing home, contact a New York elder abuse attorney at once. Your loved one has rights, and unsatisfactory treatment in a nursing home or elder care facility is unacceptable.

Dawn Andrews, a Certified Nurse’s Aide at a Clinton County nursing home facility in Plattsburgh, has been sentenced to three years probation and 100 hours of community service following a case of neglect that resulted in a resident’s fall from a toilet, which led to a fracture. The aide will also be required to pay $700 in fines.

Andrews reportedly failed to follow a care plan for toileting and left a resident along during toileting. The resident suffers from dementia, and was left alone even though the current care plan calls for assistance and monitoring when a resident is using the toilet. The resident suffered a hip fracture as a result of the fall.

Unfortunately, this scene takes place all too often in nursing homes and elder care facilities, where staff members often offer an excuse of “it happens.” Elderly people do fall more often, as they often lose strength and become feeble. This is no excuse in a nursing home, where our elderly family members are expected to be cared for and nurtured. Staff members, nurses and aides should all abide by the rules, and monitor all residents closely so that unfortunate accidents like this one do not happen. This could have easily been prevented if the nurse’s aide had followed the care plan set forth by the nursing home.

It is true that elderly people are more prone to falling, but never accept excuses for nursing home neglect. Staff should carefully monitor residents when they are getting out of bed, toileting, showering or even getting up out of a chair if they are feeble or suffer from conditions that make them unstable.

If your loved one has fallen or been injured in a nursing home, or you suspect that they are being neglected or abused, do not hesitate to take action. Contact a competent Buffalo NY nursing home injury attorney who can advise you of your rights, and what action if any should be taken.

CBS news got an upclose and personal look at what takes place when a nurse, who is supposed to be taking care of elderly patients, causes unconscionable harm. Now, the NY attorney general is filing criminal charges against the nurse, Jessie Joiner, who worked at the William Benenson Rehabilitation Pavilion in Queens.

A camera had been placed to protect both patients and staff, and footage revealed that Joiner apparently jerked a wheelchair out from underneath an elderly woman, resulting in a broken hip.

This horrific incident took place after 9 p.m. in mid-March, as Joiner is captured on video tape pushing a medication cart along. Suddenly, the nurse abandons the cart and heads in the direction of the patient who is 85 years old and suffers from dementia, who is in a wheelchair. Joiner then proceeds to jerk the wheelchair sharply to the left, leaving the elderly woman to go flying to the ground.

In late May, Joiner hid from CBS 2 HD cameras following a court appearance.

In the video, Joiner is seen walking by the patient twice after the incident, as the patient lies flailing on the ground with a broken hip. Incredibly, two minutes later another employee appears at the seen, and it looks as though he is going to help; over one minute goes by before he is seen speaking to the patient. After three minutes have passed since the initial fall, Joiner is seen returning to the area where she finally calls for help.

Joiners attorney says that clearly the elderly woman was leaning over to get something, when Joiner saw her and ran to help – but it was an instant too late.

Unfortunately, our elderly loved ones often get treated in an inhumane way in nursing homes. The very facilities that are meant to protect and care for our loved ones are often the places where harm and neglect are inflicted.

If you suspect abuse or neglect of your loved one in a nursing home facility, contact a reputable New York nursing home abuse attorney. This kind of treatment is absolutely not acceptable, and those responsible for these types of horrors should pay.

Connecticut state investigators conducted a “surprise” investigation at a New Haven nursing home, the West Rock Health Care Center. Now, the facility is being closed down based on the results of that investigation.

The owner of West Rock Health Care, Anthony Pinto, was forced to file bankruptcy in 2009, after running out of money. He has owned the facility since 1998, and states that this year he was pushed out as owner and forced to close the nursing home.

Pinto doesn’t understand why the facility should be shut down, and says the state has been at West Rock Health Care since April 12th correcting problems. He believes that the investigation findings were mistakes on the part of the facility, but since no one died he should not be shut down.

In the report by Department of Public Health regarding the investigation, 37 pages found numerous violations on the part of the nursing home. According to these pages, patients were found in beds on sheets that were accumulated with soiling, and many resident’s apparently had not been seen to regarding personal hygiene, as hair was greasy and unkempt.

The Department of Health also found that out of four residents reviewed, all four were not provided medications on a timely basis. Boxes of patient medical records were sitting in pooled water, and a nurse was found to have cleaned an open ulcer on a patient using the same washcloth that was used to clean the patient, which contained fecal material.

Pinto stated, “believe me, I understand that’s not an easy piece of paper to take. I was concerned like everyone in this facility but my God it was correctable.” Pinto also called the closing a travesty.

The closing of West Rock Health Care will result in 79 patients needing to be placed in other nursing homes, and the loss of 90 jobs.

It seems that nearly every week, there are reports of abuse and/or neglect in nursing homes across the nation. Some of this is neglect by staff members to provide personal care and medicine, while other reports involve physical abuse to residents. Families who place loved ones in a nursing home expect that they will be well cared for, but this is often not the case.

If circumstances cause you to suspect that your loved one is being neglected or abused in a nursing home, contact a New York nursing home abuse and neglect lawyer at once to determine what rights your loved one has and what actions may be necessary to correct the problem.

A Westchester County nursing home in Briarcliff, New York was fined by the U.S. Federal Government recently to the tune of $38,150 following substandard care findings stemming from a September 2009 investigation. Elant at Brandywine was fined after surveyors found that systems for monitoring and preventing residents that have wandering behaviors and cognitive impairment were inadequate. The nursing home was cited according to the inspection report. This left residents with the ability to exit the facility and wander about undetected, which puts them in danger of getting lost or being injured.

A resident who was cognitively impaired eloped from Elant at Brandywine two days before surveyors investigated, then wandered out again during the night. About 3 1/2 hours later, the resident was found by a staff member who was on her way to work more than 3 miles away from the facility. Given the residents medical history, she should have been wearing a Wanderguard monitoring device, but staff members had not placed the device on her. As a result of this incident, the nursing home received an immediate jeopardy citation, which is the most serious classification.

Nursing home residents with dementia or Alzheimer’s are at serious risk when not properly monitored and capable of leaving a facility without supervision. Elopement can and often does result in fractures, falls, heat stroke, hypothermia and other serious injuries.

Cases like this are unfortunate, and represent the neglect that takes place in many of our nursing homes today. While this isn’t the same type of neglect as failing to administer medications or food, failing to monitor residents who may wander off and hurt themselves is still not acceptable.

If your loved one suffers from dementia, Alzheimer’s or other cognitive behavioral problems, it is essential that a nursing home facility take the proper precautions to prevent wandering or elopement. Contact a reputable New York nursing home abuse lawyer if you feel that proper precautionary measures are not being taken to protect your loved one from neglect and possible injuries.

If yourself or a loved one is injured in another personal injury incident, please consider contacting Brown Chiari; personal injury attorneys NY.

In January of this year, a resident at Texas Terrace Care Center in St. Louis Park died minutes after suffering breathing problems. State health investigators have now concluded that a veteran nurse at the facility failed to take proper action when the problem occurred. A report by the state Health Department concludes that the nurse should have called 911, and that she did not follow standard nursing procedures.

According to investigators, the licensed practical nurse also provided versions of the event that were not consistent. What she explained when interviewed about the incident and documentation of the incident in writing were inconsistent. Mat Bedard, administrator at Texas Terrace Care Center, said the nurse was no longer employed by the facility. She was hired in 1994. In the report, neither the resident nor the nurse were named.

Even when a staff member has worked in a nursing home or elderly care facility for as many years as this LPN had, neglect and abuse often take place. Our loved ones are supposed to be well taken care of and looked after properly, which is why we place them in these facilities. All too often, a shortage of staff or simple lack of compassion leads to abuse or neglect. Hygiene procedures are often skipped, medications may not be given on time, and those at risk of falling or hurting themselves in some other way are not given the attention they need to prevent injuries or even death.

If you have a loved one in a nursing home or elderly care facility that you suspect is being abused or neglected, speak with authorities. If you get no resolution or suspect that your loved one is not being taken care of in the proper manner, discuss the matter with a reputable New York nursing home abuse attorney. Improper treatment of a loved one is not acceptable!

Recently, the K.F. Jammer Manor, a Missouri nursing home for veterans, has come under fire following allegations of nursing home neglect and sexual abuse of veterans. An impromptu inspection by Veterans Administration staff was performed after state agencies began investigating claims of nursing home abuse. In one incident, investigators began searching following a hot-line tip that came in alleging a female veteran had been sexually abused by a nursing home employee.

Since this incident, several veterans have been moved from the facility, and the Veterans Administration says that numerous other requests to be moved have been made by veterans. The owner of K.F. Jammer Manor strongly denies the charges of sexual abuse.

The Missouri Department of Health and Senior Services performed an investigation in 2009 in which it was determined that veterans are often neglected. Violations that were found included medications not being given over time periods in excess of one month. One patient who suffered from a psychotic disorder was not given medications for over a month, while another who needed heart medication was not given the medication for 14 days. In addition, many of the veterans rooms were damaged and dirty.

Missouri Department of Health and Senior Services spokesperson Kit Wager stated that “No one wants to do a slip shot investigation,” and said that “When allegations are made and they are serious, we look into them immediately. We were there immediately.” She stated that the facility is being looked in to in it’s entirety, along with the allegations of sexual abuse. The VA says that veterans who wish to be removed will be, and that surprise nursing home inspections will continue.

It is a shame what goes on in nursing homes today. Not only do we have to worry about our loved ones not being given necessary medications that keep them alive, now it appears that sexual abuse is another worry. Being fed on time, cleanliness, rest and good care are things we expect from a nursing home, but all too often do not get.

When you feel that something is not right or it is evident that your loved one is being abused or neglected, discuss your concerns with nursing home authorities. If you get no relief, talk to a New York nursing home abuse and neglect attorney. Your loved one has rights, and they need to be protected.
